Home Affairs Minister, Dr Aaron Motsoaledi, is scheduled to engage the National Khoi’San Council to get views on a new marriage policy representative of all the people of South Africa, united in their diversity. Section 20 of the Traditional Leadership and Governance Framework Act, 2003, enjoins traditional leaders to perform certain functions of the State. In this case, they include registration of birth, death and customary marriages.

The National Khoi’San Council has a major role to play in ensuring South Africa adopts a marriage policy responsive to South African realities where customary and civil law coexist. 

The Free State Premier, Ms SE Ntombela, is also scheduled to address the dialogue.

The Ministerial Dialogue will focus on embracing indigenous and cultural practices in marriage law while observing Constitutional values of equality, non-discrimination and human dignity. The dialogue with the National Khoi’San Council and other policy dialogues are an important part of the process of developing a new marriage policy which will inform the drafting of a single marriage policy.
